1. Introduction

1.1. These Terms and Conditions (“Terms”) govern the contractual relationship between Wheelix International Co. Ltd. (“Wheelix”, “we”, “us”, or “our”) and the Users of our booking platform (“Platform”). By accessing or using our Platform, Users agree to be bound by these Terms. If Users do not agree with any part of these Terms, they must not access or use our Platform.

 

2. Definitions

2.1. “Platform” refers to Wheelix’s website and mobile application through which Users can browse, book, and pay for motorcycle tours.

2.2. “User” refers to any individual or entity accessing or using our Platform, including but not limited to customers, tour operators, and third-party service providers.

2.3. “Operator” refers to tour operators and service providers who list their motorcycle tours on our Platform for booking by Users.

 

3. Purpose and Scope

3.1. The purpose of our Platform is to provide a convenient and secure environment for Users to discover, compare, book, and pay for motorcycle tours offered by Operators.

3.2. These Terms govern the use of our Platform, including browsing, booking, payments, cancellations, and any interactions between Users and Operators facilitated through our Platform.

 

4. Registration and Account

4.1. Users are not required to register or create an account to browse motorcycle tours on our Platform. Our Platform does not provide any functionality for user registration.

4.2. Wheelix does not collect personal information from Users for registration purposes. However, Users may be required to provide certain information during the contact us and booking process, as outlined in our Privacy Policy.

 

5. Personal Information

5.1. Users may be required to provide personal information such as name, email address, phone number, and payment details to make bookings on our Platform.

5.2. We handle all personal information in accordance with our Privacy Policy, which Users are encouraged to review before using our Platform.

5.3. By providing personal information, Users consent to its collection, processing, and use for the purposes outlined in our Privacy Policy.

 

6. Age Restrictions

6.1. Users must be at least 18 years old to make bookings through our Platform. Individuals under 18 years of age must have parental or guardian consent to use our services.

6.2. Wheelix reserves the right to verify the age of Users and may request proof of age if necessary.

 

7. User Conduct

7.1. Users are responsible for their conduct while using our Platform and must not engage in any fraudulent, illegal, or unauthorized activities.

7.2. Users must comply with all applicable laws and regulations, including those related to intellectual property rights, privacy, and data protection.

7.3. Users must not use our Platform to promote or engage in activities that are harmful, offensive, or discriminatory.

 

8. Booking Process

8.1. Users can browse available motorcycle tours on our Platform, view tour details, check availability, and request bookings.

8.2. Once a booking request is submitted, Wheelix will process the request and communicate with the Operator to confirm availability and pricing.

8.3. Users will receive a detailed quotation including the tour itinerary, pricing, payment instructions, and cancellation policy.

8.4. To confirm a booking, Users are required to make a non-refundable deposit as specified in the booking confirmation.

8.5. The remaining balance must be settled according to the payment terms specified by the Operator.

8.6. Wheelix reserves the right to cancel or reject bookings in case of unavailable tours, pricing errors, or other unforeseen circumstances.

 

9. Payments and Refunds

9.1. Payments for motorcycle tours can be made using credit/debit cards, bank transfers, or other online payment methods accepted by Wheelix.

9.2. Users might be required to be responsible for any transaction fees associated with payments.

9.3. Refunds are subject to the cancellation policy of each tour, as specified by the Operator. Users are encouraged to review the cancellation policy before making a booking.

9.4. Deposit refunds may be considered in the following special cases:

    • If the tour operator ceases operations or cancels the tour, resulting in the inability to provide the booked service.
    • If there are extenuating circumstances beyond the control of the User that prevent them from participating in the tour, subject to review and approval by Wheelix.

10. Intellectual Property

10.1. All content, including but not limited to text, images, graphics, logos, and trademarks, on our Platform is the intellectual property of Wheelix or its respective owners.

10.3. Users are encouraged to share content, including photos and information, from the Wheelix website on social media platforms. However, when sharing such content, Users must ensure to mention and credit Wheelix as the original source of the data. This includes but is not limited to photos, tour descriptions, and any other material available on the website. Proper attribution helps maintain transparency and integrity in sharing our content across social media channels. Any other use is forbidden unless approved in writing by Wheelix.

 

11. Limitation of Liability

11.1. Wheelix acts solely as an intermediary booking platform and is not liable for the quality, safety, or performance of motorcycle tours provided by Operators.

11.2. Users acknowledge that motorcycle tours involve inherent risks, including but not limited to accidents, injuries, and unforeseen events, and agree to participate at their own risk. Wheelix will have no liability in such events.

11.3. Wheelix is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our Platform.

 

12. Dispute Resolution

12.1. Any disputes arising from or relating to these Terms or the use of our Platform shall be resolved through mediation conducted in Bangkok, Thailand, in accordance with the rules of the Thai Arbitration Association.

12.2. If mediation does not result in a resolution, the dispute shall be submitted to binding arbitration in Bangkok, Thailand, by a single arbitrator appointed by the Thai Arbitration Association.

12.3. The language of the mediation and arbitration proceedings shall be English.

 

13. Governing Law

13.1. These Terms and the use of our Platform shall be governed by and construed in accordance with the laws of Thailand.

 

14. Entire Agreement

14.1. These Terms constitute the entire agreement between Wheelix and Users regarding the use of our Platform and supersede any prior agreements or understandings.

PRIVACY POLICY

1. Introduction

1.1. This Privacy Policy (“Policy”) outlines how Wheelix International Co. Ltd. (“Wheelix,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information obtained from Users (“you,” “your,” or “Users”) of our booking platform (“Platform”).

2.1. We may collect personal information from Users when they browse, book, or interact with our Platform. This may include but is not limited to:

b) Payment information such as credit/debit card details (Note: Wheelix does not store payment information directly. Payments are processed securely through third-party payment processors).

a) To Operators for the purpose of fulfilling bookings and providing services.

6.1. Our Platform may contain links to third-party websites or services. Wheelix is not responsible for the privacy practices or content of these third parties. Users should review the privacy policies of third-party sites before providing any personal information.

7.1. Wheelix may use cookies, web beacons, and similar tracking technologies to enhance user experience, analyze trends, and gather information about User interactions with our Platform. Users can adjust their browser settings to manage cookies preferences.
